Questions to ask a debt lawyer

When preparing for your bankruptcy case it is important to speak with multiple lawyers and find out which one works best for you. Asking potential bankruptcy lawyers some basic questions will tell you a lot about the attorney’s approach and if they will be the right fit for you moving forward.

The first question you should ask a banrktupcy lawyer is; Which type of bankruptcy should I file for? Chapter 7 or Chapter 13?

You should ask the lawyer this question, and see how easily they are able to describe the differences to you. If you feel that they have answered the question in a way that makes sense it means they have a good understanding of bankruptcy cases. If you feel that the attorney is fumbling over his or her words, it is generally a red flag and you should not elect to work with that attorney moving forward.

Ask the debt lawyer what fees you will have to pay?

You are hiring them to represent you in your bankruptcy case. You should know the fees that are going to be associated with that. Ask them how much the fees are for filing, their administrative fees, and of course how much the attorney will cost. If the fees are much higher than you anticipated ask him or her why. They may be a great lawyer who truly deserves those prices, or someone who is just in it for themselves.

What problems or setbacks should I anticipate?

Filing for bankruptcy is a tough process. You should understand the emotions and stress that goes along with it. Make sure that you have realistic goals and expectations when filing for bankruptcy, and more importantly that the lawyer understands these goals and expectations. Being on the same page with your bankruptcy lawyer goes a long way into a smooth filing process.

What information will you need from me?

Finally make sure to ask the bankruptcy lawyer what information he or she will need from you. Know why you are filing for bankruptcy and what was the cause of it in the first place. After determining the issue, your lawyer will let you know whether you qualify for Chapter 7 Bankruptcy or Chapter 13 Bankruptcy. So be prepared to answer a few basic questions from the attorney, and have the necessary paperwork ready for the meeting itself.
